ANALYSIS OF THE APPLICATION OF THE LAW IN RELATION TO DOMICILE IN NIGERIA

ABSTRACT: The purpose of this research project is to analyse the application of the law in relation to domicile in Nigeria. The study will focus on examining the legal framework surrounding the concept of domicile in Nigeria. During the course of this research, it has been observed that there is a significant gap in the application of the rules of Domicile, particularly in inter-state situations such as Nigeria. According to the traditional understanding, the principle of Domicile states that in order to establish a Domicile of choice, an individual must fulfil certain requirements, including the primary condition of having an intention to permanently or indefinitely reside in a specific country or location. It is not feasible or practical to implement this in Nigeria. Nigeria is a nation comprised of multiple states, each characterised by diverse ethnicities. Within this context, there is a notable level of population mobility driven by intermarriages, employment opportunities, and the pursuit of better living conditions. The necessity to address this inappropriate situation serves as the rationale for conducting this research. Given the aforementioned circumstances, the primary aim of this research is to ascertain the challenges associated with the current practise and subsequently propose feasible recommendations to effectively address these identified challenges. Upon thorough examination, this research study concludes by suggesting, among other recommendations, that the requirement for acquiring Domicile of choice should include the consideration of habitual residence, rather than solely relying on the intention to permanently reside in a specific location. The research methodology employed will consist of a doctrinal approach, utilising various sources of information such as relevant text materials, statutes, judicial decisions, journals, and internet sources.
